Purpose
The purpose of this policy is to establish
and delegate to a FUDTA committee authority and guidelines for implementation
of the Sick Leave Bank (hereinafter "SLB") obligations of FUDTA
under the FUDTA/FUSD collective agreement.
Committee
A FUDTA SLB Review Committee (hereinafter
"Committee") shall be formed, consisting of 3 to 5 members appointed
by the FUDTA President, and approved by the Executive Board. Committee members
serve for one school year.
The names of Committee members shall
be kept confidential. The Committee shall be responsible for screening and
approving requests for use of sick leave from the Bank.
The Committee shall meet to review
and approve requests for SLB days on the 4th Thursday of each month of the
school year.
Procedures
A. Donations
SLB Donation forms will
be provided in September to every unit member covered by Sick Leave provisions
in the contract. Site Reps will collect donation forms and return them to
FUDTA by the second Rep Council meeting of the school year.
When a teacher is newly
hired into the District after the first day of school, he/she has 45 calendar
days to elect to join the SLB effective that first year. If the newly hired
teacher does not join within that 45-day period, he/she must wait until
the following school year to again be eligible to join.
Adult School teachers
have the option of contributing either three (3) or six (6) hours to the
Bank and being eligible to receive up to 90 or 180 hours, respectively.
Pre School teachers may donate 4 hours and are eligible to receive 120 hours.
All other
eligible unit members will donate six (6)
hours and are eligible to receive up to 180 hours.
Names of donors will be
kept at the FUDTA office. Donors will receive official acknowledgment that
their donated day(s) is (are) now officially entered in the SLB pool.
The name of the donor
shall be kept on a SLB pool active list until the donated sick leave is
assigned to a recipient. This could, conceivably, mean that the donor and
her/his donated sick leave could be in the pool for several years depending
upon the number of donors and requests for SLB days per year.
The active donor list
shall be established in random computer order. Once a donated day is assigned,
the donor's name will then be added to the bottom of a reserve list to be
used only when all donor names/days on the active list have been assigned.
A unit member's name must
appear on the active or reserve donor list in order to be eligible to make
a request for SLB days.
A donor may, at any time,
remove her/his name from the SLB pool lists by requesting to do so in writing.
As donated days are assigned,
FUDTA shall notify each donor in writing within fifteen days so that s/he
can verify appropriate deduction of Sick Leave days on her/his pay warrant.
A. Assignments
FUDTA shall inform FUSD's
Payroll Supervisor in writing which employee's sick leave account is to
be debited and which one to be credited.
For every 10 SLB days
donated to a member, 1 Differential Pay Sick Leave Day shall be charged
to the unit member. (Contract Article 8.2.3).
As donated days are assigned,
FUDTA shall notify each applicant in writing within fifteen days of the
Committee's determination regarding the application.
A unit member who claims
her/his application for SLB day(s) was wrongly denied by the Committee,
may appeal in writing to the FUDTA Executive Board no later than two weeks
from the date of the written notice from the Committee denying the application.
The FUDTA Executive Board shall review the matter, and in its discretion
may either affirm or reverse the Committee's decision. Within its discretion,
the Executive Board may determine to conduct a hearing at which the applicant
may present her/his case before making a determination regarding the appeal.
A determination of the Executive Board regarding an appeal shall be final
and binding on the unit member and the Committee.
C. Confidentiality
To assure confidentiality
and impartiality, each member requesting SLB days shall be given a case
number, and Committee members will see only the case number and not the
name of the applicant.
Information shall not
be released by the Committee that would reveal the identity donors, applicants,
recipients, or their specific illness, except as necessary for implementation
of this policy or as otherwise required by law.
Standards for Assignment
The Committee shall be guided by the
following standards in determining assignment of SLB days to applicants:
1. A unit member must be on record as
having donated at least one sick leave day to the SLB in order to be eligible
to receive donated SLB days.
2. SLB days may be assigned only to a
unit member suffering a verifiable severe or disabling illness or injury.
3. SLB days may be assigned to a unit
member ONLY when all available full-pay sick leave time of that member has
been exhausted.
4. To insure wide access to members and
because SLB days available are limited to only 300 per year, restraints
upon usage are required. Therefore, the Committee shall grant:
a. a maximum of 30 SLB days to an individual
in one year;
b. no more than 50 SLB days to any number
of individuals in the first quarter, not to exceed 100 in the first semester.
5. Unused SLB days from the first semester
shall be available for usage in the second semester, for an annual maximum
of 300 days.
6. These days will be increased as new
days are gained in future bargaining agreements.
7. The 30-day annual individual cap may
be exceeded under the following circumstances: the member requests a waiver
of the cap; the member demonstrates to the Committee good cause for the
waiver; and the Committee in its discretion and based on the good cause
shown approves the waiver.
